1. Acceptance of terms

By accessing and using the NIS2 Manager platform, operated by BetterQA SRL ("Company", "we"), you agree to these terms and conditions. If you do not agree, please do not use the platform.

2. Service description

NIS2 Manager is a software platform that helps organizations assess and manage compliance with the NIS2 Directive and national implementing legislation. Services include:

• Compliance assessment and gap analysis
• Report and document generation
• Compliance evidence management
• Deadline notifications and tracking
• AI assistant for NIS2 guidance

3. Limitation of liability

The Company is not responsible for:

• Business decisions made based on platform information
• Sanctions or penalties resulting from non-compliance
• Incorrect interpretation or application of NIS2 requirements
• Indirect, consequential, or profit losses

4. User account

To use the services, you must create an account. You are responsible for:

• Maintaining the confidentiality of access credentials
• All activities performed from your account
• Providing correct and up-to-date information
• Immediate notification in case of unauthorized access

5. Acceptable use

You agree not to:

• Use the platform for illegal or unauthorized activities
• Attempt to gain unauthorized access to systems or data
• Distribute malware or malicious code
• Copy, modify, or distribute platform content without permission
• Use the platform in ways that could harm other users

6. Intellectual property

The NIS2 Manager platform, including source code, design, logo, texts, and all associated materials are the property of BetterQA SRL and are protected by copyright and intellectual property laws.

Data you enter into the platform remains your property. You grant us a limited license to process this data exclusively for providing the services.

7. Subscriptions and payments

Certain features require a paid subscription. Specific conditions:

• Prices are displayed in EUR or RON, including VAT
• Subscriptions automatically renew at the end of the period
• You can cancel your subscription at any time from account settings
• Refunds are provided according to our refund policy

8. Availability and interruptions

We strive to keep the platform available 24/7, but we do not guarantee uninterrupted operation. There may be periods of unavailability for maintenance or updates. We will notify users in advance of planned interruptions.

9. Service termination

We reserve the right to suspend or close your account in case of:

• Violation of these terms
• Non-payment of subscription
• Fraudulent or illegal activities
• At your request

10. Modification of terms

We may modify these terms periodically. Significant changes will be notified by email or by displaying an announcement on the platform at least 30 days before taking effect.

11. Applicable law

These terms are governed by Romanian law. Any dispute will be resolved by the competent courts in Cluj-Napoca, Romania.

12. AI Assistant and Auto-Generated Content

The NIS2 Manager platform includes an artificial intelligence-based assistant that provides recommendations for NIS2 Directive compliance. By using this functionality, you understand and accept the following:

• Informational nature: All recommendations, remediation plans, and guidance generated by AI are strictly advisory and informational.
• Does not replace expert advice: AI-generated content does not replace advice from a certified cybersecurity, compliance, or legal specialist.
• Implementation responsibility: Your organization bears full responsibility for evaluating, adapting, and implementing any security measures.
• No guarantees: BetterQA SRL does not guarantee the accuracy, completeness, or applicability of AI-generated recommendations for your specific situation.
• Liability exclusion: BetterQA SRL is not responsible for any damage, sanction, fine, or loss resulting from decisions based on AI assistant content.
• Data processing: To generate personalized recommendations, your organization's data (sector, size, assessment responses) is processed through third-party AI services, in accordance with our Privacy Policy.

We recommend consulting a specialist before implementing critical security measures or submitting official documentation to authorities.
